Hurt on the job and your employer has denied the claim?

You can sue your employer for benefits through the Delaware Industrial Accident Board.  First, you must notify the employer of your injury immediately.  Second, seek medical attention. Remember you can choose your own doctor.  If you are unable to work ask your doctor for disability slips.  Collect your medical bills. Contact an attorney who is knowledgeable about workers' compensation law.

Is your employer threatening to fire you because of a work injury?

Your employer cannot discriminate, punish, or threaten you in any way for filing a workers' compensation claim.  If the employer does so, you may have legal recourse.

What happens if I file a petition with the IAB?

You will be examined by the Employer's doctor.  If there is a dispute as to the cause or length of your disability, a hearing will be held within four months from the date the petition was filed. The industrial accident board will decide your case and you will receive a monetary award if you win your case.
